Berkeley County Release Meanings

A Berkeley County release begins when one custodian ends physical control, but that event does not always mean the person is free of all custody or supervision. The Sheriff makes arrests and transports prisoners. West Virginia, through the Division of Corrections and Rehabilitation, operates the regional jail that normally receives a Berkeley County arrestee. Eastern Regional Jail and Corrections Facility therefore holds the booking, jail-status, detainer, and release material in most local cases. The court holds the bond, dismissal, sentencing, or release order that explains the legal basis. Those records have different owners even when they concern the same person.

A name dropping from a WVDCR current-jail result is only a lead. The person may have left on bond, completed a term, entered community supervision, moved to Martinsburg Correctional Center and Jail for classification, transferred to another prison, or gone into federal or immigration custody. Death or a data correction can also end an active listing without a community release. Reliable Berkeley County released inmate research identifies the exit event, the authority for it, and any receiving agency. A release order plus a WVDCR exit or discharge record provides a much firmer answer than roster absence alone.

Berkeley County Release Types

The label attached to a Berkeley County release determines the next check. Bond and a court-ordered release can end jail custody while the criminal case stays open. Time served or sentence expiration addresses a custodial term, but another case or hold may remain. Parole, probation, home confinement, and Day Report place a person outside an institution under distinct forms of legal control. A transfer continues custody. Each outcome must be described on its own terms.

Berkeley County Release Record Fields

A complete Berkeley County release record ties a person to a particular booking or commitment and explains how that custody ended. WVDCR Policy 151.00 identifies records that may appear in the legal file, including an Offender Information Report with a photograph, court documents, detainers and holds, Orders of Release, discharge certificates, final-discharge records, and release checklists. A booking photo helps distinguish people with similar names, but the photo itself does not prove when or why someone left.

The strongest proof combines legal authority and physical processing. A signed court order can precede the actual ERJ exit while staff clear holds and complete release steps. A parole grant can precede community release as well. Record both events when their times differ. For a transfer, name the receiving agency instead of calling the event a community release.

Request Berkeley County Release Records

Send a Berkeley County jail-release request to the custodian that holds the named record. For an ERJ or MCCJ booking, that is normally WVDCR, not the county Sheriff. Identify the full name, OID or booking number if known, date range, facility, committing court, and exact existing documents. Ask for the Offender Information Report, release order, release checklist, discharge or final-discharge record, relevant detainer disposition, and time sheet as needed. Berkeley County Release Record Law

West Virginia Code §29B-1-3 provides access to inspect or copy nonexempt public records when a request describes them with reasonable specificity. The agency must furnish the record, arrange inspection, or give written reasons for denial within the statutory response period. Section 29B-1-4 lists exemptions, including privacy-sensitive material and some law-enforcement investigative records. Juvenile, sealed, medical, victim, and security information can require withholding or redaction.

WVDCR maintains cumulative offender records and preserves conviction information under §15A-4-14, but no verified source gives one numerical retention period for the full adult release file. The records program follows an approved retention schedule by record series. Ask which schedule line controls the particular order, photograph, checklist, time sheet, or discharge certificate instead of assuming that every item remains online for the same length of time.

Berkeley County Bond Releases

Berkeley County's Wanted Persons guidance asks people arranging surrender to do so between 9 a.m. and 4 p.m. That schedule gives them an opportunity to go directly before a magistrate and post bond, and it helps reduce off-hours detention. It does not establish a general ERJ release window. A bond entry means the case can continue outside jail; it is not an acquittal or sentence completion.

For a reported bond-out, compare the magistrate or circuit bond entry with the filed order and ERJ release event. One case's bond does not clear a second warrant or detainer. If the order and physical exit have different times, preserve both. The court record explains why release was authorized, while WVDCR records when its custody ended.

Berkeley Release Property and ID

Property and identity papers can require prompt action after a Berkeley County release. WVDCR admission policy warns that personal property left after release may be disposed of 30 days after the release date. Its offender-record policy also identifies certain driver's licenses, Social Security cards, vaccination cards, and other identity documents kept in the legal file pending release. The WVDCR property policy requires an authorized pickup person to show identification and sign a receipt.

Call the releasing facility when property or identification was not returned. Confirm which location holds it before traveling, especially when the person moved between ERJCF and MCCJ. A release record can show the custody exit, while the facility's property record shows what remained and who may retrieve it.

Berkeley Release Records After Expungement

Expungement can explain why an old Berkeley County case, index entry, or booking photograph is no longer public. West Virginia Code §61-11-25 includes photographs and index references within the records that may be covered after qualifying dismissals, acquittals, and other eligible outcomes. Section 61-11-26 provides a separate route for eligible convictions and directs removal of sealed electronic court information from public access.

The Berkeley Circuit Clerk maintains expungement files. A vanished public result may reflect lawful relief, not a failed search and not proof that no arrest or case ever existed. Sealed and expunged material should not be reconstructed from stale copies. When a lawful need remains, ask the clerk what can be confirmed and follow the order's access limits.

Start a Berkeley County released inmate search by classifying the custody. ERJ detainees belong on the WVDCR jail side while confined. State prisoners belong on the WVDCR prison side. WVDCR Released Offender Search

The WVDCR Offender Search hub separates jail, prison, Daily Incarcerations, and Escapees and Absconders tools. Use the jail search for a person confined at ERJ and the prison search for a DCR commitment. A public inactive, released, or discharged state-prison status can corroborate that WVDCR no longer confines the person. Pair it with the discharge record when the exact release date and type matter. A blank result can reflect spelling, record scope, access failure, or a person who was never in state-prison custody.

WVDCR policies use minimum discharge/final release date for the time-sheet calculation. The prison profile has also been documented with a Projected Release Date field. Copy the live label exactly. A parole eligibility date, projected release date, and actual release event describe three different milestones and should never be merged.

Berkeley County Recent Release Limits

Berkeley County publishes no official Sheriff jail roster, 24-hour release list, 72-hour release list, recent-release archive, or inmate app. The county's Find an Inmate page sends users to WVDCR and the Federal Bureau of Prisons. WVDCR's Daily Incarcerations and jail search show present custody, not everyone released during a past window. Repeating a current search does not create a reliable archive.

Berkeley Release Supervision Options

A person can live in Berkeley County without appearing in an institutional search and still remain under legal control. WVDCR Parole Services supervises parole, while the West Virginia Parole Board makes release decisions. Berkeley Circuit Probation handles court probation. Home confinement and the Day Report Center are separate county channels. Verify the exact status with the order and the office assigned to it, not with a generic custody search.

The Berkeley Day Report Center at 520 South Raleigh Street provides assessment, treatment, accountability, and reporting for eligible nonviolent participants. It operates Monday through Friday from 8 a.m. to 8 p.m. Berkeley County reported 85 graduates in its 2024-2025 fiscal-year report. Graduation is a program measure, not a jail-release count. The center's role shows why an out-of-jail status can still carry structured obligations.

Parole from a regional jail has another timing trap. The Board says a grant is followed by transfer for DCR intake and fingerprinting, with release anticipated seven to ten days later. Berkeley Release Notices and Transfers

West Virginia VINE covers WVDCR correctional facilities and all ten regional jails, including ERJ. Search a specific person by name or offender ID, compare identifiers, and read the reported custody status. Phone, text, email, and app notification choices depend on the interface. WVDCR also publishes 1-866-984-8463 for custody information and automatic telephone notice. A released or out-of-custody VINE label is useful corroboration, but it does not rule out a transfer, another jurisdiction, or a later arrest.

Federal and immigration records require different systems. The BOP locator covers federal inmates from 1982 forward and may show a past release date with no institution or a Not in BOP Custody status. It does not show state jail custody, ICE custody, or federal supervision. ICE ODLS uses exact identity data and can include some people released from ICE custody within the preceding 60 days. Under-18 records, suppressed cases, exact-match problems, and delays make a not-found result inconclusive.

A person leaving ERJ for the U.S. Marshals Service, BOP, or ICE remains in government custody. Use the federal court order for a pretrial release question, BOP after commitment, and ODLS for immigration custody. No public historical USMS locator comparable to BOP was found. Name the receiving system whenever a Berkeley County jail exit is a transfer.

Berkeley Release Record Offices

Berkeley County's main release-related offices sit close together but keep separate records. Courts, the Circuit Clerk, and circuit probation are at the Judicial Center on West South Street. The Sheriff is at 510 South Raleigh Street. Home confinement, community corrections, and the Day Report Center are at 520 South Raleigh Street. Their proximity does not make one office the custodian of every file.

Use the court for the bond, dismissal, sentence, probation, or release order. Use the Sheriff for its arrest, incident, warrant, transport, or extradition record. Use WVDCR for ERJ or MCCJ booking, custody, detainer, release, time-sheet, and discharge material. Use the supervising unit for present community status. A narrow request sent to the office that created the record is faster to assess and less likely to produce a valid no-record response.

Berkeley Release Transportation

WVDCR has a dedicated Release Transportation directive for state-operated facilities. ERJ publishes driving directions but does not promise a public release door, family waiting point, fixed exit hour, or transit stop. Call ERJ at 304-267-0045 before arranging pickup. Confirm that the person is actually leaving to the community and ask only for disclosable logistics.

Do not assume a court order fixes the physical exit time. Staff may still process property, identity papers, detainers, transport, and final records. If someone is moving to MCCJ, another DCR institution, USMS, BOP, or ICE, family transportation is not the next step because custody continues.

Berkeley Release Facility History

Two WVDCR facilities stand close together on Grapevine Road but perform different work. The current Eastern Regional Jail and Corrections Facility has operated since September 1999 and serves Berkeley, Jefferson, and Morgan counties. Martinsburg Correctional Center and Jail occupies the building that opened as the original Eastern Regional Jail in 1989. WVDCR describes MCCJ as a male intake and classification facility with a stated capacity of 120.

A change from ERJCF to MCCJ, or from MCCJ to another prison, can be routine institutional movement. It must not be labeled release to the community. Search the prison side, compare the institution field, and obtain the transfer or discharge record. Also confirm the committing county because ERJ serves three counties and holds a mixed custody population.

Berkeley Release Status by Custody

The same search does not answer every Berkeley County release question. Match the system to the legal custodian, then seek a second independent layer that explains the change.

Current ERJ custody

Use WVDCR jail search and Daily Incarcerations. These are current-status tools, not a release history.

Released ERJ detainee

Use VINE, the Berkeley court case, and the WVDCR release order, checklist, or discharge material.

State-prison discharge

What is the minimum sound confirmation? Identify the agency custody or release event and pair it with the court or Board authority that explains it. If only a current-search absence exists, report that the person was not found and that release is not yet confirmed.

Berkeley County Release Facilities

Berkeley County has no identified county-operated adult jail. The facility route depends on who made the arrest, who now holds the person, and whether the change was release or transfer.

• Eastern Regional Jail and Corrections Facility (ERJCF) is the principal regional jail serving Berkeley County. Confirm an exit with WVDCR, VINE, and the court.
• Martinsburg Correctional Center and Jail (MCCJ) handles male intake and classification. Movement out often leads to another prison rather than the community.
• Berkeley County Sheriff's Office holding and transport function covers arrest and transport records, while WVDCR normally holds the regional-jail release file.
• Federal contract or pretrial custody at ERJ can end in USMS or BOP transfer, a federal court release, or an immigration pathway.

Ask which agency created the exact record. A Sheriff arrest report, WVDCR release checklist, court order, BOP locator result, and ICE custody event are not interchangeable.
