Berkeley County Good-Time Calculation

A simplified lawful calculation begins with the maximum indeterminate term or fixed determinate term. It then includes qualifying presentence custody credit ordered under §61-11-24. For an eligible adult in commissioner custody, §15A-4-17 generally grants one day of good time for each eligible day physically incarcerated. Consecutive terms are aggregated as the statute directs, and exclusions must be applied.

West Virginia does not have a universal rule that every inmate serves 85 percent of the sentence. That federal-style shortcut should not be applied to a Berkeley County DCR term. Life sentences receive no good time. Excluded commitment categories and offense-specific sentencing provisions must be checked. Good time also is not earned while the person is on parole or bond.

A detainer can also change what happens at the door without rewriting the underlying sentence date. When another authority takes custody, the DCR confinement may end while government custody continues. The release checklist and detainer disposition should name the receiving authority. Describe that event as a transfer, not community release.

Berkeley County Parole Eligibility Dates

A parole eligibility date is not the minimum discharge/final release date. Under §62-12-13, eligibility generally begins after the minimum indeterminate term or one fourth of a definite term, subject to conditions, exclusions, institutional conduct, accelerated provisions, and Board judgment. It means the West Virginia Parole Board may consider release. It is not a promise that parole will be granted.

The Board decision and physical exit also occur at different times. Official Board guidance says that a person granted parole from a regional jail first transfers for DCR intake and fingerprinting, with release anticipated seven to ten days later. That gap matters in Berkeley County because ERJCF is a regional jail. Report the grant date as a decision and the later facility event as the actual exit.
