Berkeley County Mugshot Record Limits
A mugshot, or booking photograph, is an identity image made in connection with an arrest or corrections record. It remains tied to that historic event after the person leaves custody. The photograph alone does not show whether the person posted bond, completed a sentence, transferred, entered supervision, obtained a dismissal, or received an expungement. Pair it with the case and release documents.
West Virginia does not support a simple statement that every booking photo is always public or always confidential. WVDCR Policy 151.00 confirms that an Offender Information Report includes a photograph. That establishes the record’s existence in the offender file, not automatic disclosure of every image. A request goes to the actual custodian and remains subject to FOIA exemptions, redaction, juvenile protections, and sealed or expunged status.
For an ERJCF or MCCJ image, WVDCR is usually the strongest booking-record channel because the state operates both facilities. The Berkeley County Sheriff can possess photographs attached to its own arrest or incident report. It should not be assumed to possess the regional jail’s intake image. Name the booking, facility, date range, and identifier so each agency can search the record it actually maintains.
Find Berkeley County Released Mugshots
No official Berkeley County released-mugshot feed, Sheriff inmate roster, local booking gallery, or Sheriff inmate app was found in the county’s official inmate, Sheriff, and Services pages. The county instead directs inmate searches to WVDCR and federal tools. That means a person who left ERJCF cannot be found through a local historic photo feed that the county does not publish.
Use channels according to what they can prove. Save the source and the date checked. When an image is attached to a public profile, also save the displayed status without treating it as a permanent release history. When a current-custody search stops returning a person, the accurate statement is that the person is not found in that search; the release still needs another record.

The Berkeley County 24-hour release page explains why the available current searches are not an official recent-release list. The same limit applies to photos: a current image or a vanished image does not establish the release event.
Berkeley County Official Photo Channels
For a regional-jail booking, start with WVDCR. Ask for “the booking photograph maintained with the identified booking,” the Offender Information Report, and the release documents needed to place the image in context. For a state-prison commitment, the prison offender search may show a photograph and status, while the offender file provides the stronger records-request route. Use the jail search only for regional-jail custody and the prison search for corrections custody.
For a Sheriff arrest, use the Berkeley County Sheriff Services page and report form. It explains that photographs, when available, carry additional charges. The screenshot below is the successful manifest capture matched to Berkeley County photo requests.
The page supports the request route, but it does not prove that a particular photo exists or that the Sheriff holds ERJCF’s intake image. Separate the Sheriff incident-photo request from the WVDCR booking-photo request.
VINELink may supply custody events but should not be described as a permanent photo archive. A press release or official news item may show the image used when an arrest was announced. Always retain its publication date and check the later court and release record. Arrest context does not become release proof with age.
Request Berkeley County Booking Photos
A focused photo request asks for an existing record rather than demanding a new report. For ERJCF or MCCJ, give WVDCR the full name, offender or booking number, date range, facility, and committing Berkeley County court. Ask for an electronic, segregable copy. Include the release order or discharge documents in the same request if the goal is to connect the image with an actual release.
- Identify the booking precisely. Use the person’s full name, known identifier, facility, booking range, and court case.
- Send the regional-jail or corrections request to WVDCR as custodian. Name the Offender Information Report and booking photograph.
- Send a separate request to the Sheriff only when seeking a photograph attached to its arrest, incident, or transport record.
- Ask for electronic delivery and the segregable, nonexempt portion if protected material is mixed with the photograph.
- Preserve the sent date and response. A timely FOIA response may produce, arrange inspection, deny, partially redact, report no record, or explain continued production work.
- Match the returned image to identifiers and pair it with the official court disposition and release record.
West Virginia FOIA §29B-1-3 requires reasonable specificity and a response within the statutory five-day period excluding weekends and legal holidays. It permits actual reproduction cost, not search or man-hour charges. The Sheriff’s current report form separately lists $25 for up to twelve photographs when such photos exist. That fee applies to the Sheriff channel; it does not establish WVDCR’s production cost.

Note: A denial of a photograph does not automatically justify withholding a segregable release date, facility, or release category from the proper record.
Berkeley County Sheriff Photo Records
The Berkeley County Sheriff’s Office accepts FOIA requests by email at BCSOrecords@BerkeleyWV.org, by mail, or in person at 510 South Raleigh Street, Martinsburg, WV 25401. Its official FOIA policy says a written request is advisable. The Sheriff report request form lists $20 for an incident or crash report up to fifty pages, $25 for up to twelve photographs, and other stated charges for additional or specialized media.
Those details do not turn the Sheriff into the custodian for every Berkeley County mugshot. The Sheriff makes arrests, provides court security, transports prisoners, and handles extradition. WVDCR normally keeps the ERJCF booking, offender photo, detainer, and release material. If the Sheriff says it does not possess the intake photograph, redirect that narrow booking request to WVDCR while keeping the Sheriff request limited to its own report attachments.
If an exemption is cited, ask for the exact statutory basis and the segregable nonexempt portion. Protected narrative, medical facts, juvenile details, victim data, and security material can be separated from basic record fields where the law permits. Do not infer that an agency’s inability to locate a photo means the booking did not occur. Check aliases, identifiers, the facility, and the booking range.
Berkeley County Historical Mugshot Sources
Third-party mugshot aggregators can preserve copied booking images long after release. They may omit the release type, confuse people with similar names, retain an old photo after an expungement, or fail to update a court outcome. Treat the category as a lead only. No commercial mugshot or data-broker URL should outrank the agency record, and no paid removal service is endorsed.
Local news and agency press releases can also document a historical arrest image. Berkeley County does not publish an official local-news release series, so an article should be dated and described as an account of what was known then. Link the identity and arrest context forward to the official docket, release order, or discharge record. Do not leave the old image as the last word on the case.
A useful verification note identifies the image source, publication or record date, person identifiers, booking or case number, and later disposition source. If only the photo is available, say that the booking image was found while current custody and release remain unconfirmed. If a current official profile displays the photo, record the status as shown and preserve the check date because profiles can change.
Berkeley County Expunged Photo Records
Expungement can explain why an old Berkeley County booking photo, index, or case disappears. The Berkeley County Circuit Clerk expressly keeps expungement files. Under §61-11-25, the statutory definition of records for eligible acquittals, dismissals, and qualifying outcomes includes arrest records, fingerprints, photographs, and index references.
Section 61-11-26 provides a separate route for eligible convictions and defines electronic-court sealing as removal from the public website. Extensive timing rules and offense exclusions apply. A granted petition can lead agencies to expunge covered records and remove sealed electronic court material from public access. That lawful relief is different from a broken search or proof that no booking ever occurred.
When a once-visible image is gone, check the public docket only to the extent it remains available and contact the Circuit Clerk using lawful identifiers. Do not republish a stale copied image merely because another category of source still has it. If a government agency retains a nonpublic or exempt record after relief, public absence and agency retention can both be true under the applicable rules.
Note: Describe the current access result and the official expungement record; never infer the person’s history solely from a vanished or surviving photograph.
Berkeley County Social-Post Removal
West Virginia Code §62-1-6a is the confirmed booking-photo publication rule. It generally limits a law-enforcement agency’s social-media posting of a minor-offense booking photo unless a conviction, fugitive or imminent-threat finding, or court order applies. After a listed favorable result, such as dismissal, no indictment, acquittal, or reversal, the agency must remove its social post within fourteen days after a request by the subject or authorized representative.
The statute is narrow. It does not create a Berkeley County released-mugshot archive. It does not categorically decide whether a photo must be disclosed under FOIA, and it expressly excludes DCR from its definition of a law-enforcement agency. The captured official code page below preserves the publication rule at the source.
The code page is the authority for the social-post process. A requester should identify the agency post and qualifying outcome, provide the record needed by the statute, and preserve the request date. No separate broad West Virginia law expressly banning commercial pay-to-remove practices was found in the official-code sweep, so no broader removal promise should be made.
Required use restriction. Berkeley County Released Inmates is not a consumer reporting agency under the FCRA. Mugshot information may not be used for credit, employment, hiring, housing, tenant screening, insurance, background checks, or any other FCRA-regulated purpose.
